Actually, the Patent Office returns the majority of
the fees -- $1,690 of $2.52K for ex parte
reexamination (where the challenger does not
participate after the initial reexamination request)
and $7,970 of $8.8K for inter partes reexamination
(where the challenger participates in the entire
process). This means that the PTO has a significant
incentive to grant reexamination requests. I have yet
to hear of a reexamination request being denied.
It *is* rare for the Patent Office to initiate its own
reexamination (no fee required), but if a third party
requests a reexamination, it is likely to be granted.
