This is just whining. See tsa.gov. The policy is clear: containers
more than 3 fluid ounces are not allowed.
If we are going to get legalistic, let's not invent language that the
TSA does not use.
At <http://www.tsa.gov/press/happenings/
9-25_updated_passenger_guidance.shtm> the language the TSA uses is:
"Travelers may now carry through security checkpoints
travel-size toiletries (3 ounces or less)travel-size
toiletries (3 ounces or less)..."
Serge Egelman was carrying 3 oz or less and the TSA employee agreed
with that assessment.
There is nothing that specifies what size "container" the 3 oz or
less must be carried in. The word "toiletry" is not a synonym for
"container".
Assuming that the concern is for dangerous materials, rather than
dangerous sizes of containers, the TSA's current wording is just
fine, but the TSA employee's behavior was not.
The employee was being a petty tyrant, which is indeed what this
thread is about.
It is not "whining" to take exception to erratic and petty behaviors
by agents of the government.
