At the risk of tooting our own horn, I think that the memo referenced  
below provides a focused and useful critique of DOJ's data retention  
proposals.  Our concerns are based in part on discussions that CDT's  
Nancy Libin (and others) had with DOJ officials yesterday on the topic.

Data Retention Plan Lacks Privacy Safeguards; Could be Costly
Forcing Internet service providers and other telecommunications  
companies to retain data about their customers' habits for up to  
two years would threaten the privacy of innocent Americans, be of  
dubious value for law enforcement and could raise costs for users,  
the Center for Democracy & Technology said in a memo released today.
CDT drafted the memo in response the Justice Department's mounting  
effort to either persuade or force ISPs to dramatically increase  
the length of time for which they retain customer data.
"We recognize the need for law enforcement to have access to  
information to fight crime and terrorism, but in light of recent  
revelations about unchecked domestic government surveillance and  
data breaches, and given the weak privacy protections that apply to  
these sorts of records, the DOJ data retention proposal raises  
serious concerns about individual data privacy and security," CDT  
Staff Counsel Nancy Libin said.
