as I expected teh account of the patent given in the
original message was incomplete. The patent is not
about "send[ing] an email confirming an electronic
transaction". The pertinent portion of the patent
description is:

"When a consumer has to confirm an authorization of an
electronic transaction (e.g., "online" purchase order
via credit card, or signing a contract, etc.), the
entity requesting such authorization (e.g., merchant,
credit card company, etc.) will leave a "notification
message" (e.g., voice mail or e-mail) at a
predetermined, private electronic mailbox associated
with the consumer. The location of the private mailbox
is not communicated by the consumer to the merchant or
bank during an electronic transaction. Instead, the
merchant or bank will contact an e-Notary based on
information provided by the consumer (e.g., IP address
of the e-Notary, etc.)"

So the patent is not about the common practice of
having a consumer send an Email to confirm a Email
list subscription etc. IN this case the Email is not
provided in the transaction but is provided by a
trusted thrid party.

This application is about verifying identity in a way
suitbale for a finnacial transaction. It is a
different issue than the one described in teh original
cvomment and done in a different way.

So a patent that describes a different issue done in a
different way is objected to because it bears a
superficial similarity to some practice.
