Subject: DMCA Exemption rulemaking replies - deadline Feb 2 2006 5pm

[The DMCA rulemaking process is broken, but there are some significant items]

http://www.copyright.gov/1201/comment_forms/index.html

"The Copyright Office is conducting a rulemaking proceeding mandated
by the Digital Millennium Copyright Act, which provides that the
Librarian of Congress may exempt certain classes of works from the
prohibition against circumvention of technological measures that
control access to copyrighted works. The purpose of this rulemaking
proceeding is to determine whether there are particular classes of
works as to which users are, or are likely to be, adversely
affected in their ability to make noninfringing uses due to the
prohibition on circumvention of measures that protect access.
   ...

The deadline for electronic submissions is 5:00 P.M. E.S.T ... Feb. 2.
Commenters are strongly encouraged to submit comments well in
advance of the deadline to allow sufficient time to correct any
format defects and resubmit comments before the deadline.

Submissions must follow the format detailed in the notice of inquiry."

"This is a supplement guide, concerned with the next round of that
   policy process."

DMCA Reply Comments: The Rootkit Exemption
http://www.eff.org/deeplinks/archives/004329.php

"DMCA exemptions are defined in reference to a class of copyrighted
works rather than a particular use of those works. Consumers,
therefore, would also be free to remove software installed on their
machines that posed security risks, allowing them to enjoy their
lawfully purchased CDs on the playback device of their choice
without risking potentially crippling security vulnerabilities."

DMCA Reply Comments: The Cell Phone Locking Exemption
http://www.eff.org/deeplinks/archives/004330.php

"Were you forced to buy a new handset or remain with your current
provider because your phone was locked in to a particular network?
Have you been unable to use your handset internationally because of
firmware limitations? If you can offer this sort of personal and
specific factual information in support of this comment, we urge
you to file a reply comment with the Copyright Office."
