According to the Washington Post, Judge James Robertson has resigned  from
the FISA court because of the administration's secret surveillance 
program.  The article cites his concerns that information from these 
secret wiretaps could have been used to gain FISA warrants for later 
investigations.  One source said "They just don't know if the product of
wiretaps were used for FISA warrants -- to kind of cleanse the
information... What I've heard some of the judges say is they feel they've
participated in a Potemkin court."  The presiding judge of the FISA 
court, Colleen Kollar-Kotelly, knew about the secret surveillance  program
and insisted that the Justice Dept certify in writing that they  were not
using the wiretaps that way.
