It still has
features that TiVo doesn't touch such as commercial advance.
This feature will never appear in players newer than the series
that it was in.
This was part of the settlement that allowed ReplayTV's current
owners to avoid
the lawsuit that killed the original company through litigation
costs. I was
part of the EFF lawsuit (Newark v. Turner) that was joined into the
28 media
companies against ReplayTV. We were in that suit specifically to
establish a
personal right to space shifting and commercial advance.
The suit was settled, so we were unable to pursue a conclusion.
However, we did
set a precedent that consumers have the right to participate in
lawsuits in
which infringing uses are cited as a reason a company should be
held liable.
