What ever happened to obligation of agencies to adhere to proper notice
and comment decision-making procedures?

In addition, this decision also seems to be in conflict with the Privacy
Act of 1974 (5 USC 552a - don't miss the little 'a', else you have FOIA.)

I have heard a rumor that the head of NTIA, the agency behind this
privacy-busting rule, is one of the candidates to replace Powell at the
FCC.
