But Cohen has warned that BitTorrent is ill-suited to illegal
activities, a view echoed by John Malcolm of MPAA.
"People who use these systems and think they're anonymous are
mistaken," Malcolm said. Asked if he thought sites like Suprnova were
illegal, he said: "That's still an issue we're studying, that
reasonable minds can disagree on," he said.
It seems that if the MPAA follows a similar path in tracking BT users
they will have special clients written that probe BT and capture the
IP addresses of other clients holding copyright material. Some BT
clients allow the use of proxies for both tracker and peer
communications. If BT users avail themselves of proxies (especially
offshore services that have non-logging policies) it would seem to
greatly complicate the MPAA's and RIAA's task. Unlike government
security agencies, like the NSA, which routinely monitor and capture
Internet traffic for analysis, the MPAA and RIAA must use court orders
served on ISPs identifying suspected copyright violators. If they
cannot determine where the client is then they cannot draft the court
orders and those users may be effectively shielded.
BTW, Bram and I worked together at Mojo Nation, a now defunct P2P
service, which pioneered many of the distributed technologies used by
BT and other advanced P2P services.
