If a doctor is not a Medicare provider, he can charge whatever he
chooses. There are two classes of providers, those that accept
Medicare assignments, and those that don't. If they don't accept
assignment, but are still providers, they are still bound by
reimbursement restrictions, although they get somewhat more
according to Medicare scale.
The penalty for patients of such doctors is if they have secondary
insurance, often that insurer will deduct what Medicare would have
paid, even if it didn't, before reimbursing patient.
