Dave,

Dr. Hazlett's general position that deregulation probably works better than
legislative mandates to stimulate innovation and investment, and,
eventually, competition is almost certainly correct. He seems to imply,
however, that network unbundling, which has been at the forefront of
regulatory squabbles for eight years, was introduced by the regulators. In
fact, it was mandated by the 1996 Act, that required interconnection at any
"technically feasible" point, a perfectly disastrous nostrum. The regulators
certainly didn't do a very good job of crafting rules to implement
unbundling, but the fundamental problem is in the legislation.
