[IP] more on reply to criticism Fwd: Re: [CSL Colloq] Controlling Digital Cloth * 4:15PM, Wed May 12, 2004 in Gates B03 (fwd)

I happen to disagree. Normally any employee can get a waiver for a talk at a school. I have had NSA give open talks (they said what they wanted people to hear of course). I just strongly believe that the University should be open to all to talk and to hear.

I'm a staunch supporter of fair use rights (if you don't use 'em, you lose 'em), but this issue is just *NOT* about fair use. Fair use is all about third parties being able to make use of copyrighted materials without the permission of the copyright owner. If Dennis, or anyone not associated with ILM, were to be giving this talk then the whole area of fair use would be appropriate for discussion.

However, in this situation, it's an employee of ILM and *NOT* a third-party who is making this presentation. I'm certain that ILM is either itself the copyright owner or, more likely, has specific contracts with the copyright owners about how and when they may duplicate the copyrighted works. As an employee of ILM, I also am certain that Ari has signed employment agreements which explicitly preclude making any unauthorized copies of ILM's copyrighted works or the copyrighted works of their clients.

In other words, all of the complaints so far are akin to complaining that ILM as a company should disregard their contracts and just allow their clients' works to be copied -- and that is just not about fair use.
