Note that most of the bigger software producers also favor classifying software as a service and not a product because that:
1) reinforces the licensing that protects attempts to expand copyright control
2) reinforces their position with respect to defense against civil product liability lawsuits

I've actually heard this argument made by several officials associated with large software firms.
