Dear At-Large representative:

The ALAC monthly newsletter has noted the 21 September
ICANN Advisory entitled ?Registrar Expired Name Market
Developments?, wherein it is stated that certain
?registrars have announced that they intend to auction
the rights to domain names in the event that
registrants fail to renew them at the conclusion of a
grace period following expiration. Instead of names
"dropping" back into a "pool" of names available for
re-registration on a first-come, first-served basis,
names would instead remain at the current registrar
and would be re-assigned to the control of the highest
bidder.?

Your committee has opened a forum on this topic, and
by now you will have noticed that all comments
tendered on this topic do not support the actions of
such registrars.  

As an advisory committee you have the right under the
ICANN bylaws to initiate a policy development process
within the GNSO to deal with this issue:


Annex A: GNSO Policy-Development Process

The following process shall govern the GNSO policy
development process ("PDP") until such time as
modifications are recommended to and approved by the
ICANN Board of Directors ("Board").

1. Raising an Issue
An issue may be raised for consideration as part of
the PDP by any of the following:
     a. Board Initiation. The Board may initiate the  
PDP by instructing the GNSO Council ("Council") to
begin the process outlined in this Annex.
     b. Council Initiation. The GNSO Council may
initiate the PDP by a vote of at least twenty-five
percent (25%) of the members of the Council present at
any meeting in which a motion to initiate the PDP is
made.
     c. Advisory Committee Initiation. An Advisory
Committee may raise an issue for policy development by
action of such committee to commence the PDP, and
transmission of that request to the GNSO Council. 


At present, ICANN has no established policy on
warehousing or on domain name speculation by
registrars or registries; the language in the
Registrar Accreditation Agreement confirms this: 

4.2 Topics for New and Revised Specifications and
Policies. New and revised specifications and policies
may be established on the following topics:

     4.2.5 prohibitions on warehousing of or
speculation in domain names by registries or
registrars


As actions being taken by certain registrars at this
time will effectively thwart the pending
implementation of the Expired Domain Deletion Policy
(which is scheduled to commence 21 December 2004), it
is paramount that policy be developed expeditiously.

I ask you to formally convene to raise this issue for
policy development and to transmit such request to the
GNSO.
