In the BIZ STOP policy, those STOP complaints were required to be filed any
time from when the domain name was registered within a very short cutoff
period, and certainly before most .biz domain registrants were able to
establish use of any kind.
In the .info sunrise, TM rights were determined to pre-empt any other use to
which a term might be put.
If you don't believe that TM owners are going to be rattled by finding (a)
they don't have the domain name they want, but it will soon expire, and (b)
someone else is holding the 'place in line' for it, then you are
underestimating the tenacity of these people.
Intellectual property owners constitute an ICANN constituency. Domain name
registrants don't. It is that simple.
